Terms of Service & Release of Liability

In consideration of being allowed to participate in any way with the swimming instructor, related events and Flo's Club Swimming Lessons.

Activities the undersigned acknowledge, appreciates, and agrees that:

  1. There is a risk of injury from the activities involved in the program. While particular rules, equipment, and personal discipline may reduce the risk, the risk of serious injury does exist; and,

  2. I ACKNOWLEDGE AND FREELY ASSUME ALL SUCH RISK, know both and unknown, and assume full responsibility for my participation; and,

  3. I willingly agree to comply with the stated and customary terms and conditions for participation. If however I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

  4. I, hold myself and on behalf of all my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Flo's Club Swimming Lessons, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property.

IN READING THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT FULLY, UNDERSTAND ITS TERMS AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND SIGN IT FREELY AND VOLUNTARILY WITHOUT AND INDUCEMENT.


FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/guardian, with legal responsibility for this participant, do consent and agree to their release as provided above, all the Releases, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify the Releases from any and all liabilities incident to my minor child(ren)’s involvement or participant in these programs as provided above.


In past years we believe that we have been more than fair in attempting to reschedule classes for some families in order to accommodate for the changes in vacations, birthday parties, play dates etc. even after the program had already started. With intermittent thunderstorms that can happen during the summer months, we make it our first priority to provide make ups to those families directly affected from us being forced to cancel their child’s class time. Our major goal is to fulfill our commitment to those families first.

Dates and times listed below are what we mutually agreed upon during our phone or email conversation. Before you leave today please read over the list of dates and times attached and make sure that we haven’t made any errors in writing this up.

We will try, but neither guarantee make-ups nor do we provide refunds; you have in reality paid for the times that we discussed before arriving here today.  Please understand that although your child may not be in attendance for the class, I and any other instructors are in attendance and have saved that time especially for you.


Returning Families: Please try to bring your child(ren)’s previous report card! It is a great way to track their progress and save paper!

Bad Weather: If on the day of your class there is heavy rain, Carina will try to get in touch 30-60 minutes before the start of your class. We can postpone and reschedule to the next available date.

If we get rained on during class, we will continue with our lesson (parents/caretakers are welcome to sit under the covered area of the deck) unless we hear thunder. We can tack on any lost time in the next class (if possible).

Friendly reminder for the summer session I do not guarantee makeups; with that said I always will try my best to accommodate for missed classes.
